The Commercial Manager – Investments will oversee all commercial aspects of the Investments business unit. Working in close collaboration with the General Manager, you will manage all commercial risk and governance across the different stages of a project, from tendering through to operations. You will act as a key point of contact throughout pre-sales and during delivery phases in relation to contractual and commercial issues, working very closely with the Project Managers.

Your Challenge

  • Contract drafting, review of contract terms and negotiation of:
    • contract leases and concession agreements with landlords
    • design and installation agreements with subcontractors
    • terms and conditions of the end user membership scheme
    • contract terms with other suppliers and potential partners ensuring that key risks are flowed down (when applicable i.e. KPI’s) and that risks are modelled and priced appropriately
  • Working in collaboration with Investments Strategic Account Manager, progressing agreements/Heads of Terms with landlords
  • Design and implementation of commercial governance processes including monthly Cost-Value Reconciliation (CVR) for projects in installation and operations phase, pre-contract risk assessment, etc.
  • Working very closely with the Project Manager (PM) in ensuring projects are delivered on time and budget. We expect you to be up to date with the status of the projects and support the PM across all stages
  • Liaising when required with third party advisors
  • Obtaining (in conjunction with operations and legal) all third party consents (including wayleaves, easements, confirmations from landlords, approval of plans etc) required for EV charging infrastructure installation
  • Pricing of design and installation works for EV charging infrastructure, including issuing RFP’s to subcontractors and managing mini-tender processes for subletting packages of installation work
  • Preparation of financial models for new investment opportunities for investment board committee presentations
  • Manage applications for payment from subcontractors, assess value of work delivered and liaise with SWARCO’s finance team to approve payments
  • Resolving contractual and commercial problems identified
  • Work to identify, manage and mitigate business and contract risk during pre-sales and project delivery phases
  • Key point of contact through the negotiation stages, in conjunction with managers, offering direction and instruction
  • Produce handover packs identifying key commercial risks and mitigation strategy
  • Work alongside the management teams to maximise commercial opportunities whilst minimising business risk as well as embedding process, discipline and diligence throughout contract management
  • Managing all contractual claims and disputes with clients and supply chain
  • Ensure all records and data are kept fully up to date on the appropriate systems and trackers

Your Profile

  • Experience of working as a Commercial Manager or similar, ideally in a relevant sector
  • Degree or equivalent experience in areas of Business, Quantity Surveying, Law, Engineering, Construction Management or Cost Engineering
  • Self-starter. As a newly created team, we’d need you to be able to think proactively and come up with ideas and implement new processes
  • Be very practical, making wise decisions balancing risk and return and ensuring opportunities and commercial negotiations progress quickly

  • Financial modelling skills should be at a user level. You will not be required to develop new financial models, but to be able to use the existing ones, interrogating the results and ensuring they are correct
